Without the intention of downgrading the work of the relevant services or responsibility, it is clarified that the alleged incidents of domestic violence, regardless of their origin, are prioritized and accompanied by immediate police actions.

Police are implementing the legislation provided for in the current legislation and respond either on the basis of the results of the pre -trial procedure or in accordance with more specific orders from the Public Prosecutors.

In this case, all the procedures provided for in investigating the complaint were applied and the data gathered were immediately put into account the competent Public Prosecutor’s Office within 24 hours of ordering the order for further evaluation.

The Police Service, at no stage of the preliminary examination or further procedure, had a legal capacity to perform an act of arresting or restricting the alleged perpetrator, as:

* At the time of submission of the original report, the deadline for self -esteem had already expired, in accordance with the Code of Criminal Procedure.

* The pre -trial material was immediately submitted to the Public Prosecutor’s Office, but the new Public Prosecutor’s Office did not include a detention order or other restrictive measure, which is a prerequisite for such actions in unauthorized cases.

In any case, the Police Authorities, when they do not conduct an ex officio pre -trial investigation and do not exist on the offenses, shall act in accordance with the content of the Public Prosecutor’s Office.
