The reasoning of decision No. 8/2023 of the 404 pages of the A1 Political Department of the Supreme Court was published, with which the parties were declared and the party of Ilias Kasidiaris (“Greek National Party”) was not allowed to participate at parliamentary elections of 21 May 2023.

According to the decision of the CA, Ilias Kasidiaris “incites the use of violence, promotes a policy that does not respect democracy and aims to weaken and destroy the democratic state and the institutions of the rule of law”.

Furthermore, it is stated that “the real leadership of the ‘Greek National Party’, from its foundation until today, has never ceased to be exercised, exclusively, by its founder, Ilias Kasidiaris”.

In closing, the decision states:

“In this case, therefore, it appears that the party “Greek National Party”, whose real leader is Ilias Kasidiaris, declared as a candidate for parliament, encourages the use of violence, promotes a policy that does not respect democracy and aims to weaken and destruction of the democratic state and the institutions of the rule of law, in particular by the use of violence or the incitement of violence or its justification, the promotion of totalitarian ideologies, the spread of racist and intolerant ideas and xenophobia, the approval of crimes against humanity, hatred against persons and groups, actions and declarations that threaten the peaceful coexistence of social groups in the country.

Consequently, the “Greek National Party” should not be declared and, therefore, participate in the national elections of May 20, 2023 and May 21, 2023.”

Furthermore, the court decision refers to the long-term course and activity of the Golden Dawn criminal organization and highlights a multitude of incidents, statements, public appearances in which Ilias Kasidiaris demonstrated illegal activity.

According to the Areopagite decision, Ilias Kasidiaris “knew and fully adopted the transformation of the political party into a criminal organization, to whose will he had submitted his will and its criminal activity in general. He was fully aware of the characteristics of this organization as a criminal one, which he supported with all his might fervently and in every way proclaimed its principles and positions, with hate speech, spreading its theories of the extermination of all groups or individuals targeted by the Golden Dawn, as political or racial enemies, while additionally engaged in the training and familiarization of its members and executives in the harsh military training and in the use of military weapons, as can be seen from the photographs reviewed and the videos shown, where he appears either alone of or together with other unknown persons to use firearms in the countryside and in unorganized target areas. He, like his other co-accused, made public statements demonstrating the power of the party and rewarding extreme behavior and criminally hellish acts of its members, executives and followers, while he himself had demonstrated extremely aggressive and violent behavior.

At another point, the court decision refers to Ilias Kasidiaris’ relations with the party he had founded, and in particular:

“Ilias Kasidiaris, diagnosing the risk of not declaring the aforementioned party, which he himself had founded and managed alone, attempted to publicize his alleged estrangement from its leadership, however solemnly confirming the opposite, that is, that he never ceased to be the only real leader, who undertakes to defend the legitimacy of this (party). Otherwise, if Ilias Kasidiaris had really retired from the leadership of the party in question – and not, as he pretentiously claims – then the above extrajudicial should have been signed by the people who (allegedly) made up his administration, as only having the legal interest to this end, given that this amendment, which was finally passed (Article 102 of Law 5019/2023/Government Gazette A’ 27/14-2-2023), concerns the right to be elected as a party candidate and the conditions declaration of this party.

Subsequently, on 9-2-2023, Ilias Kasidiaris, via the internet, once again managed to oppose the aforementioned amendment, stating, literally, that “I let them advertise me” and repeating that, allegedly, he is not interested in managerial positions , but to fight from any position even from the last one. These statements by Ilias Kasidiaris confirm, blatantly, the strategies, in order for someone else to appear as the real leader of the party in question”.

Special reference is made to the statements of Ilias Kasidiaris and specifically refers to the decision:

“On 9-2-2023, i.e., one day after the passing of the controversial amendment in the Parliament, Ilias Kasidiaris, shares, via the internet (youtube), his first statement, entitled “So I will go down Decision Number: 8/ 2-5-2023 p. 80 in the elections”, preparing the ground for his alleged removal from the leadership of the aforementioned party, which, for three years, he had founded and organized (“Greek National Party”), in principle allegedly assigning it to a multi-person body (managing committee), stating that he is not interested in management positions and that he can “fight” from any position, even from the last one.

On 3-4-2023, Anastasios Kanellopoulos, leader of the party “EAN…” announced, with his statements, which were also broadcast by a news bulletin of a pan-Hellenic television station and have been posted on the internet, verbatim, that “I will be head of the party of Ilias Kasidiaris in the elections, it has been launched… There needs to be some procedures, constitutional procedures of this party, some modifications to be made. And then, after I submit the statute to the competent prosecutor of the Supreme Court, then I will be, if things develop like this, president”, after his discussions and consultations with Ilias Kasidiaris.

On 4-26-2023, on the eve of the expiration of the deadline of article 37 par.1 of the p.d. 26/2012, Ilias Kasidiaris, through the statements of his lawyer and with his relevant post on the internet, announced that in the upcoming elections he will be a candidate for parliament in the 1st electoral district of Athens with the “Hellenic National Party”, now chaired by Dimitrios Hatziliadis, brigadier general

In his related post on YouTube, the following are mentioned, among other things: “More than half a million Greeks are currently supporting our Party. We have an obligation towards them to fight the great political and legal battle until the end. Any sworn government or judicial agent who attempts to illegally disenfranchise half a million Greeks and abolish free elections will commit the felony of high treason, punishable by life imprisonment.

Also, the Areopagites mention:

“With these facts, it is clearly demonstrated that the real leadership of the “Greek National Party”, from its foundation until today, has never ceased to be exercised, exclusively, by its founder, Ilias Kasidiaris, who decided and implemented the above methods, installed and recalled, at will, its respective alleged leaders – presidents, while, even after the installation as alleged leader initially of Anastasios Kanellopoulos and, subsequently, of Dimitrios Hatziliadis, he did not stop exercising, he alone , pre-election campaign in favor of the party in question, promoting his positions and program, with repeated postings on the internet, despite being a prisoner, as quoted above, emphasizing, in fact, that the controversial amendment to the electoral law was an advertisement for him. On the contrary, the alleged leader of the party in question, Dimitrios Chatziliadis, did not make any statement, action or position, to promote the positions and program of this party”.
