New data in the course of the course of the pre -trial committee is created by the letter of Christos Triantopoulos in which he calls on the House to pave the way for regular justice, prosecuting him for breach of duty and referring him to the natural judge for the final judgment. This development is already causing a new outbreak of political conflict with Kyriakos Mitsotakis describing it as a brave step that has no modern precedent and the opposition accusing the government of having a new attempt to conceal.

The decisive meeting

Since the pre -trial committee – as a dominant body – accepts Mr Triantopoulos’ request, which is expected to be discussed at the meeting next Thursday at 12 noon, then a date (in a reasonable time) is set to draw up the Commission’s findings on the basis of the reports on the basis of the reports. It is recalled that the proposal to set up a preliminary investigation submitted by PASOK and voted by the majority of 277 MPs concerned the prosecution of a breach of duty to the former deputy minister.

Given that the “blue” lineup has the majority, regardless of the opposition’s stance, the plenary is expected to vote in favor of the finding by secret ballot (the absolute majority of 151 MPs) and to refer Christos Triantopoulos to the five -member Court.

It is an instrument consisting of 5 senior judicial (3 of the Supreme Court and 2 of the CoE) elected by drawing by the plenary and appointed by a member (coming from the Supreme Court) to undertake the investigative work. The Judicial Council is what will decide on the court to refer the former deputy minister to the Special Court.

What offenses can be referred to?

In any case, his reference by the pre -trial committee to the plenary and then to the Judicial Council shall be exclusively for the indictment included in the proposal that set up the Parliamentary Committee, in this case that PASOK. In practice this means that it can be exercised against the prosecution only for breach of duty to a degree of misdemeanor. In order to expand the indictment, either to other offenses or to other persons, a new request is required and to be approved by the plenary.
