The Senate approved this Wednesday (8) the bill establishing the General Sports Law, which consolidates in legislation all the rules referring to sports practices. The text covers from the concept of athlete to the doping prevention policy, funding funds for the activity, crimes in sport and combating racism in stadiums.
The bill was approved in a symbolic vote in the House. He goes to the Chamber of Deputies.
The project’s rapporteur, Senator Leila Barros (PDT-DF), conceptualized sport as “any form of predominantly physical activity that, in an informal or organized way, has the objective of recreational activities, health promotion, high sports performance or entertainment”.
One of the novelties is the provision in the text of the crime of private corruption. According to the text, the representative of a private sports organization that demands, requests, receives or even accepts the promise of an undue advantage to perform or omit an act inherent to its attributions will commit a crime. The penalty ranges from two to four years and a fine.
Among the non-profit private sports organizations are the COB (Brazilian Olympic Committee), the CPB (Brazilian Paralympic Committee), the CBF (Brazilian Football Confederation), football clubs and other national sports administration entities. Last year, the law that allows football clubs to set up as profit-making companies was passed.
The project also provides for the creation of Sinesp (National Sports System), which will be responsible for managing and promoting public policies for sports. It is up to the federal sphere the general rules. The coordination and execution of the programs is the responsibility of the states, federal district and municipalities.
Sinesp will have permanent deliberative bodies with the participation of the government and civil society.
The text also mentions the creation of Fudesporte (National Sports Fund), which depends on the approval of the PEC (Proposed Amendment to the Constitution), which is still pending in the Senate.
Its objective is to provide everyone with access to sports. In addition to creating career transition programs for athletes, promoting study, research and technological advancement in the area of ​​sport, among other objectives. The fund can have a series of revenues, such as parliamentary amendments, donations, sponsorships.
One of the advances of the project is the provision that deals with racism, xenophobia and intolerance in sport. Anesporte (National Authority for the Prevention and Combat of Violence and Discrimination in Sport) is expected to be created, linked to the Special Secretariat for Sport, of the Ministry of Citizenship, with the objective of formulating and implementing public policies on the subject.
Leila incorporated into the substitute the idea defended by Senator Romário (PL-RJ), which provides for the prohibition of imposing disciplinary penalties on athletes for free expression. The objective, according to her, is to guarantee athletes, coaches, referees and other people involved in sports competitions the right to freedom of expression, expressly guaranteed by the Federal Constitution.
“Restrictions on the expression of thought can only be justified to the extent that this manifestation proves to be disruptive or impeding the sporting event itself, or when, by its content or form, it already constitutes an illicit even in contexts unrelated to sport”, justified the senator. .
The text also incorporates the Bolsa-Atleta into the General Sports Law. In practice, little has changed: the program is still divided into categories ranging from high performance to student athletes, with values ​​ranging from R$370 to R$15,000 per month. The main point is that the incentive, intended mainly for Olympic and competitive modalities, is no longer an isolated law and becomes a permanent State policy.
The text has 218 articles and defines concepts, such as athlete and coach, points out the spectator’s rights and safety, the right to exploit the athlete’s image, the availability of the image for journalistic purposes.
