Clearview AI: Fined €20m by the Data Protection Authority

THE Personal Data Protection Authority imposed a fine of 20,000,000 euros to the company Clearview AIwhich markets facial recognition services, for illegal collection and processing of personal data.

In more detail, the Authority, with the no. 35/2022 decision, considered complaint against the company with the name Clearview AI, Inc, submitted by the Civil Non-Profit Company with the name “Homo Digitalis” on behalf of a complainant, who, according to her claims, was not satisfied in terms of the right of access she exercised before the above company .

Furthermore, the complaint also requested the examination of the arrest practices of each company from the point of view of personal data protection.

Specifically, the Authority found that in this particular case the complained company, which trades in identity recognition services, violated the principles of legality and transparency (Article 5 par. 1 a’, 6, 9 of the GDPR), as well as those deriving from the provisions of of articles 12, 14, 15 and 27 of the GDPR, its obligations, imposing a fine of 20,000,000 euros.

At the same time, the Authority addressed compliance order to the same above-mentioned company for the satisfaction of the exercise before the request for access to personal data of the complainant, while imposing on this company a ban on the collection and processing of personal data of subjects located in Greek territory, using methods included in the facial recognition service .

Finally, with the disputed decision, the Authority addressed to the company Clearview AI, Inc and an order to delete the personal data of the above subjects located in the Greek territory, which the complainant collects and processes using the above methods.
