The Federal Court of Appeals has agreed to ban Juul e-cigarettes by the US Food and Drug Administration.

The decision was made on Friday afternoon, July morning, after blocking the FDA order and requesting that all products be withdrawn from the US market.

The FDA’s temporary suspension of the order will continue until at least July 12, according to the court’s planning order.

Details of the temporary ban period were not immediately disclosed.

“The FDA’s decision is arbitrary and capricious and lacks substantive evidence,” Julie said in an emergency petition filed with the US Court of Appeals in Washington, DC. The company claimed that the FDA allowed e-cigarettes from other manufacturers.

Julie asked the FDA to stop the “abnormal and illegal behavior.”

The FDA ordered Juul to recall the evaporator and the tobacco- and menthol-flavored cartridges on Thursday.

An FDA spokesman told The Wall Street Journal that it would not comment on pending or ongoing trials.

Jul said he was consulting with legal counsel about filing for bankruptcy if the government ban could not be lifted, people familiar with the matter told the newspaper.

The FDA said that Juul could not provide sufficient evidence that its product offered a less harmful option than traditional cigarettes.

Vaping companies must prove that their devices are beneficial to public health in order to continue selling them.

Julie said that she provided enough data and information on the issues of concern to the FDA. However, regulators said there were not enough details about possible health risks and important questions remained.

Julie argued that the FDA orders were different from previous government actions and communications.

“In particular, we have ordered the company to close all businesses, so that there are no leaks or press releases driving the actions of the authorities,” Julie told the court.
