A grand jury in Ohio on Thursday indicted a man accused of raping a 10-year-old girl who had to cross state lines to have an abortion.

The indictment also claims that the girl who traveled from Ohio to Indiana for an abortion was only nine years old at the time of the attack.

Gerson Fentes, 27, was charged with two rapes by a grand jury in Columbus. Fuentes was arrested earlier this month and charged with rape after admitting to police that he had raped the girl twice.

The case is international after an abortion doctor told the Indianapolis Star that a 10-year-old girl should go to Indiana because Ohio has banned abortions at six weeks’ gestation. It drew attention. ..

Last month, just hours after the Supreme Court overturned Roe v. Wade, Ohio’s “fetal heartbeat” law went into effect. The law prohibits abortion with the first “prominent fetal heartbeat,” making it impossible for a 10-year-old to have an abortion in her home country.

Ohio law makes no exceptions in cases of rape or incest.

According to a document filed with the Franklin District Court, Fuentes faces life in prison and deportation if convicted.

The girl was only three days past the six-week mark when she left Ohio to terminate her pregnancy in Indiana, where such an abortion is still legal.

The mother reported the incident on June 22 and then took her daughter to Indianapolis for the procedure on June 30.

President Joe Biden took up the case even as he issued an executive order intended to protect abortion rights.

Fuentes will be processed on Monday. She is being held on $2 million bail to protect the girl and prevent her from fleeing the country.
