USA: Ohio Court of Appeals Reintroduces Compulsory Vaccination of Workers, as Required by Joe Biden

by

An appeals court on Friday reinstated compulsory vaccination for all employees in large companies, as desired by the government of President Joe Biden, in order to fight the Covid-19 pandemic.

Under this controversial measure, millions of employees in companies with more than 100 employees will have to be vaccinated by January 4th. Otherwise they will be forced to undergo continuous testing.

The measure was first announced in mid-September and approved by the White House in early November. States like Texas, which is controlled by Republicans who strongly disagree with the mandatory vaccination for the pandemic, immediately appealed for its cancellation. On November 6, the Texas Court of Appeals suspended its application, pending consideration of the merits. Another New Orleans Court of Appeals upheld the suspension, saying the mandatory vaccination exceeded the federal government’s authority.

“Covid-19 has been shown to continue to spread, mutate, kill and prevent the safe return of American workers to their jobs,” he told the Ohio Court of Appeals on Friday, announcing his decision. Ministry of Justice to adjudicate all appeals.

This decision can, however, be overturned if the case goes to the Supreme Court.

“In order to protect workers, the Osha (Federal Agency for Safety and Health at Work) can and must be able to respond to the risks,” Judge Jane Strandz added. He also noted that “Osha has always had expanded powers in its history to ensure the safety of workers and” demonstrated the general risk that Covid-19 poses to workers, especially the unvaccinated, in the workplace. “

The suspension of compulsory vaccination was a major blow to President Biden, who said the measure was “the best way out of this pandemic for the United States,” as the number of unvaccinated people is still high.
