Political crisis in Peru: Justice rejects former president Castillo’s request to be released from prison

The judge ruled that the failure of the “coup” attempted by the former head of state does not exempt him from his criminal responsibilities. The former president said publicly that he wanted to form a “government of exception”, in other words he meant to deviate from “the constitutional order”.

Peruvian justice on Tuesday rejected the defense’s request to release former President Pedro Castillo – accused of “stance” and “conspiracy” after his attempt to dissolve parliament last week – who is expected to remain in custody.

He ruled “unfounded” the appeal by the defense of the former president, who was suspended by Congress and arrested on December 7, said judge Cesar San Martin, reading his verdict during a hearing that was broadcast live on national television networks.

The judge ruled that the failure of the “coup” attempted by the former head of state does not exempt him from his criminal responsibilities. The former president said publicly that he wanted to form a “government of exception”, in other words he meant to deviate from “the constitutional order”.

Furthermore, in the decision, Mr. Castillo is classified as a suspected fugitive, after he sought to submit a request to the Mexican embassy to be granted political asylum.

According to a judicial source, the court considers the crime of standing to be a “common (criminal) law” offense, therefore no preliminary hearing is required, as argued by the defense.

On December 7, the 53-year-old former president, who was elected with a party of the radical left, ordered the dissolution of parliament. But his orders were not implemented by the military or any other institution, and later that day members of Congress overwhelmingly voted to remove the head of state from office for “moral unfitness.”

Pedro Castillo was arrested a few hours later by his bodyguards and remanded in custody, at the request of the prosecution. His remand would normally end today, but the prosecution is expected to ask for an extension before 1pm (local time), according to the judicial source.
