Halina Hutchins’ family prepares to file new lawsuit against Alec Baldwin

New lawsuit against the actor Alec Baldwin the parents and husband of filmmaker Halina Hutchins plan to file for her fatal gunshot wound in the of the filming of the movie Rust.

The Hutchins family is represented by the lawyer Gloria Allredwho is expected to hold a press conference later today to provide more details about the family’s decision.

Baldwin is charged with involuntary manslaughter and his first court appearance is pending.

Prosecutors in Santa Fe, New Mexico, formally charged the actor on Tuesday, January 31, 2023.

They said the actor’s involvement as a producer and as the person who fired the gun weighed in the decision to press charges.

Santa Fe County District Attorney, Mary Carmack-Altwies, filed the charging documents, which name Alec Baldwin and Hannah Gutierrez-Reed, who supervised the guns on the film’s set. Court documents say they deviated from known safety standards.

Halina Hutchins died shortly after being injured during rehearsals at a ranch outside Santa Fe on October 21, 2021.

Baldwin was pointing a pistol at Hutchins when the gun went off, killing her and injuring director Joel Souza.

The actor has vowed to “fight” the charges, while claiming he never pulled the trigger. It is noted that if convicted, he faces up to five years in prison.

American film industry protocols require assistant directors to check the barrel of each gun on set and inform the crew if it is empty, using the expression “cold gun”. The Colt, however, was full.

Investigators say the actor pulled the gun from its holster, pointed it at Halina Hutchins and fired the gun, which should have been a plastic or replica gun, according to industry standards.

Investigators say in their report that Baldwin did not show up for mandatory weapons training before the shooting and that he did not fully complete the training in the shooting, while speaking frequently with his family.

They also cite several violations of required security checks and protocols, as the gun was loaded and issued to the actor.

Baldwin’s attorney, Luke Nikas, declined to comment Tuesday and referred to an earlier statement about the case, in which he called the charges a “terrible miscarriage of justice” that he and his client will fight and win.

“Mr. Baldwin had no reason to believe there was a real bullet in the gun or anywhere on the movie set,” the statement said.

“He relied on the professionals he worked with.”

Prosecutors say the actor, as producer of the movie “Rust,” failed to consider Gutierrez-Reed’s relative inexperience as an uncertified gunsmith in her second film assignment. They claim both skipped a critical gun safety check. Hutchins’ death has already prompted new security precautions in the film industry.
