The family of an 11-year-old boy shot in his home by a Mississippi police officer will go to court seeking damages while also seeking the release of body camera footage, his lawyer announced, a day after a jury found that he should not be prosecuted.

Indianola police officer Greg Capers shot unarmed Anderien Murray in the chest inside his home last May. The child had called the police for help because his father was threatening his mother.

The jury decided not to indict Capers, finding that he did not act maliciously when he shot Marie. However, a civil lawsuit against Capers, the city of Indianola and the police chief is pending. The family is seeking $5 million in damages for the officer’s “indifference” to the child’s rights and safety.

Little Anderien survived, but the medical expenses are in the tens of thousands of dollars and “the municipality has never offered to help” cover them, attorney Carlos Moore explained in an interview today. The municipality has yet to respond to a settlement offer, he added.

The township’s legal counsel did not respond to a request for comment. Indianola police referred reporters to the Mississippi Attorney General’s office, which said it would not prosecute after the grand jury’s decision.

The judge tasked with hearing the family’s lawsuit allowed Moore and his mother Marie to view the footage from the officer’s body camera but prohibited them from releasing it to the public. The family has appealed and a decision is expected early next year.
