The US Supreme Court today restored the terms of access to mifepristonethe pill used in the majority of abortions in the United States, yet abortion rights advocates abortionincluding President Joe Biden, called for continued vigilance against threats to this right.
In their unanimous decision, the court’s nine justices, which has a conservative majority, denied the plaintiffs — medical associations or professionals hostile to abortion who do not prescribe or use it the pill. The judges are therefore overturning the appeal decision, which they had suspended anyway.
An appeals court made up of ultra-conservative judges had in 2023 reinstated several of the restrictions on access to the abortion pill mifepristone, which had been lifted by the US Food and Drug Administration (FDA) since 2016.
“The plaintiffs have not shown that relaxing the FDA rules would likely harm them“, Justice Brett Cavanaugh wrote in the ruling on behalf of the Supreme Court.
“For this reason, federal courts are not an appropriate avenue to address plaintiffs’ concerns about FDA actions“, he adds, stressing that (plaintiffs) can appeal to the executive or legislative branch.
Democratic President Joe Biden, for whom the protection of abortion rights is a milestone in his campaign for the November presidential election against his Republican predecessor Donald Trump, took note of the decision but emphasized that “the fight goes on.”
With its historic ruling in June 2022 invalidating the federal guarantee of the right to abortion, the conservative majority court once again gave states complete freedom to legislate in this area. Since then, almost twenty of them have banned abortion, whether it is by medication or surgery, or have established a strict framework.

The Guttmacher Institute, a pro-abortion research center whose studies are a reference, said it was “relieved” by the Supreme Court’s decision on mifepristone, the “only sensible decision” possible, but deplored the fact that the complaint “bad faith, and without documented or scientific basis” reached the country’s highest court.
