In a historic ruling, the US Supreme Court ruled today that former US President Donald Trump has “partial immunity” from criminal prosecution for actions while in the White House.
Specifically, by 6 votes to 3, the Supreme Court ruled that former presidents are protected from criminal prosecution for acts that fall within the scope of their official duties, and thus Trump has “partial immunity.”
Judge John Roberts said “the nature of the presidency” entitles Trump to absolute immunity from criminal prosecution for his official activities as president.
“Accordingly, we remand to the District Court to determine in the first instance whether Trump’s conduct in this area qualifies as official or unofficial,” Roberts wrote.
The Supreme Court ruled that while a president has immunity from criminal prosecution for his official activity while in office, he does not have immunity for “unofficial acts.” Thus, the document emphasizes that the Justice should distinguish between official and unofficial actions of Trump.
According to the Financial Times, the decision will allow one of the most serious trials facing Trump, who is accused of trying to overturn the results of the 2020 presidential election, to continue.
Trump: “Great victory” the decision
Former President Donald Trump hailed the Supreme Court’s ruling on presidential immunity, calling the “big win” for the Constitution and democracy.
Trump wrote on Truth Social, “Great victory for the Constitution and our democracy. Proud to be an American!”
In turn, his legal team called the court’s decision a “great victory.”
