The Manhattan District Attorney’s Office will not object to the postponement of the sentencing announcement, however, Judge Juan Merchan will have the final say
Manhattan prosecutors who secured Donald Trump’s conviction in May in a case linked to payments to porn star Stormy Daniels to buy her silence they have no objection to delaying the announcement of his sentence, which is set for July 11.
According to a court document, the prosecution will not object to the postponement of the announcement of the sentence. However, Judge Juan Mercan will have the final say and, if he agrees, will likely set a new date for after the Republican Party convention (July 15-18 in Milwaukee), where Donald Trump will also officially receive the anointing for the presidential election. of November.
On Monday, Trump’s lawyers asked that his conviction be overturned because of the Supreme Court’s ruling on presidential immunity. In a landmark 6-3 decision, the Supreme Court ruled that Trump cannot be prosecuted for acts that fall within his constitutional powers as president. But it is possible for him to be prosecuted for crimes committed in his private life.
The decision ensured that Trump would not be tried before the Nov. 5 election on the 2020 election tampering case.
In their letter, Trump’s lawyers argued that Manhattan prosecutors presented evidence at trial that stemmed from their client’s official actions while he was president, and therefore his conviction is invalid.
U.S. Attorney Alvin Bragg’s office responded that the argument has “no merit” but intends to give Trump a chance to fully develop it.
Trump has pleaded not guilty and says he will appeal his conviction for falsifying accounting documents to conceal a $130,000 payment to Stormy Daniels before the 2016 election.
