The Supreme Court on Tuesday rejected an emergency appeal to remove Robert Kennedy Jr.’s name from the ballot in two contested states.

Kennedy wanted off the ballot in Wisconsin and Michigan after withdrawing his independent candidacy and supporting Republican Donald Trump in the primary. He argued that withholding his name violated his First Amendment rights.

Michigan and Wisconsin said removing his name now, with early voting underway just days before the election, would be impossible.

The judges did not specify the reason for rejecting the extraordinary appeal.

The presence of independents and third-party candidates on the ballot in swing states could be a key factor in the outcome of the presidential race. The Supreme Court had previously rejected a separate bid by Kennedy to remain on the ballot in New York, a state where his presence is unlikely to affect the race between Trump and Kamala Harris.
