Netherlands: Two Ukrainians released from prison to defend their country

by

The detention in the Netherlands of two Ukrainians suspected of human trafficking was suspended last Friday due to the war in Ukraine and the Ukrainian government’s call on its citizens to defend their country, “extraordinary, serious conditions”, according to a Judgment of the court of Zeeland and West Brabant.

The two men, aged 29 and 27, originally from Lutsk (northwestern Ukraine), are suspected of helping 11 Albanians who were trying to reach England by boat, the prosecutor’s office told the French Agency today.

Their detention was suspended due to the “state of war in Ukraine, the call of the Ukrainian government to its inhabitants to defend their country”, the desire of the accused to respond to this appeal and their interest in being close to their families. , the court explained.

These conditions are “extraordinary” and “serious”, according to the court, which considers that the interest in the release of the two suspects “prevails in the social interest to remain in pre-trial detention”.

“As far as we know, this has never happened before in the Netherlands,” a court spokeswoman told AFP.

The suspension is not limited in time, she clarified and the suspects should not be present at their trial. However, the conditions for their release have been clarified:

“If they are sentenced to prison, they will eventually have to serve that sentence,” the spokeswoman explained.
