Government of SP will give exemption from IPVA to 375,000 drivers with disabilities

About 375,000 drivers with disabilities should be entitled to exemption from IPVA (Tax on Ownership of Motor Vehicles) 2022. Estimates are from the Secretary of Justice and Citizenship of the State and superintendent of Imesc (Institute of Social Medicine and Criminology of São Paulo), Fernando Jose da Costa.

This Friday (27), the institute opened accreditation to clinics and doctors able to carry out the expertise that will guarantee the exemption report to the disabled. The matter has been controversial this year, after the state collected the IPVA from drivers who were previously entitled to the exemption.

After collecting the tax and opening a civil action on the subject, the government announced that, until July 31, those who already had a disability exemption in 2020 and 2021 will be entitled to the benefit. The IPVA values ​​are no longer charged and those who paid the tax unduly must have the total returned.

To be entitled to the exemption, however, it will be necessary to make the request for free and undergo an expertise that proves the disability. It is for this step of the order that the accreditation was opened. The public notice with the rules was published in the Official Gazette of the state on Thursday (26).

This year, in addition to drivers with adapted cars, the exemption request is open to taxpayers with some type of disability that does not require modification of the vehicle, such as people with low vision or autism spectrum syndrome. People with sensory, intellectual or mental disabilities also fall under the new rule.

The accreditation of clinics must be carried out at Imesc. In the case of drivers, the request for expertise must be filed on a digital platform that is being developed by Prodesp. The virtual address will be published on the websites of the Secretary of Finance and the Secretary of Justice of the State

According to the secretary, the expectation is that appointments will be released from July 31. After registering on the platform and attaching the required documentation, the driver can consult the clinics and doctors available and request the exam.

“From there, the driver will have a few days to schedule the medical examination. He will be able to choose which city and location he prefers to take the exam. The service will have no cost, it will be borne by the government”, he says.

To guarantee entitlement to the benefit, the medical report will need to be signed by two experts: a doctor and a specialist such as a physical therapist, social worker or psychologist, for example. If you meet the requirements, the driver will be automatically exempted.

Also according to the secretary, the driver who proves the right to the exemption, but who has already paid the IPVA for the years 2021 and 2022, can request the refund of the money. “When the exemption is determined after the examination, these people will be able to request a refund, which will follow the administrative procedures.”
