Sickness aid without expertise can only be requested by My INSS; see how to do

Insured people who will apply for INSS (National Social Security Institute) sickness benefit without undergoing medical expertise will only be able to make the request and send the necessary documents through the Meu INSS application, according to the institute’s rules published this Monday (29) ).

Ordinance 1,486 also provides other important guidelines, such as the total period of removal in the case of those who do not carry out an in-person expertise, which is up to 90 days, in addition to the limit of 30 days to schedule a medical examination if necessary.

For lawyer Rômulo Saraiva, a specialist in Social Security and columnist for Sheet, limiting sick pay requests to the Meu INSS application can harm policyholders. According to him, there are constant flaws in Meu INSS and, in addition, citizens without access to cell phones and internet will find it difficult to obtain the benefit.

“In addition to the difficulty of the internet, there is also the connection, because it is a system that presents a lot of instability, which can be distressing and fatal for those who are counting the days”, he says.

In the publication, there are guidelines regarding the medical certificate to request assistance without expertise. According to the ordinance, the document must be legible and issued less than 30 days before the request.

The certificate for sick leave without expertise must have:

• Insured’s full name
• Rest start date
• Time required for recovery from illness
• Signature of the doctor and identification stamp, with registration of the class council, which can be CRM (Regional Council of Medicine), CRO (Regional Council of Dentistry) or RMS (Registration of the Ministry of Health)
• Information about the disease or the ICD (International Classification of Diseases)

The insured must apply for “Aid for temporary incapacity – Document Analysis – AIT”. Those who already had medical expertise scheduled can also try to help only by sending documents. In this case, the skill will be cancelled.

After making the request through Meu INSS, he will be notified about the duration of the benefit granted, which is up to 90 days, even if the leave is not consecutive. In addition, it is not possible to ask for an extension if you are still sick.

If the incapacity for work persists, the citizen will have to make a new request for sick pay, this time with in-person medical expertise, but only after 30 days from the end of the distance assistance.

Another rule says that if you need another leave within 60 days for the same reason, the worker cannot ask for help without expertise again.

How is the analysis for granting sick pay

The documents sent will be analyzed by INSS medical experts. The objective is to avoid fraud and understand if the time off work is consistent with the disease. If it is necessary to undergo medical expertise, the citizen will be notified and must schedule the expertise within 30 days.

In cases where on-site expertise is indicated, the INSS guarantees that the initial date of the request will be the day on which the citizen sent the documents through My INSS.
