The Justice determined that the Santa Catarina carrier, which promised to make the schedule of drivers who support President Jair Bolsonaro (PL) more flexible, ensure that all employees are able to vote in the second round of the elections.
Transben, a company based in Brusque (SC), provides services to Havan stores and is owned by Luciano Hang’s brother-in-law, businessman Adriano Benvenutti. The preliminary decision is this Sunday (23).
In a video distributed to Transben employees, Benvenutti asks for votes for the president and says that the company will organize the work schedule for Sunday (30) to try to ensure that Bolsonarista drivers are in the city where they vote.
“I would like everyone to call their managers and tell their managers where they vote. Of course, those who vote for Bolsonaro. Those who vote for Lula can continue traveling. vote, so everyone can vote.”
In the recording, the businessman also states that the carrier “will suffer a lot” if former president Luiz Inácio Lula da Silva (PT) wins the elections. “If Lula wins, people, there will be unemployment, devaluation of things, Brazil will stop,” he says in the video.
The carrier must send the drivers’ travel schedules to Justice between October 25th and 31st within 24 hours and is prohibited from trying to interfere with the employees’ vote. A conciliation hearing is scheduled for this Tuesday (25).
The MPT (Ministério Público do Trabalho) took legal action after the company refused to sign a TAC (Term of Conduct Adjustment). The report could not contact the defense of the businessman or Transben. Havana declined to comment.
In the injunction, the magistrate states that Benvenutti did not deny the content of the video, but “softened the tone of the speech contained therein, as a kind of joke”, and claimed that its objective was to reduce the abstention of the second round.

“In addition to the electoral harassment itself pointed out by the author, this magistrate is concerned about the promise, which a contrario sensu, also includes a threat or restriction, of better conditions to enable those who declare their vote for the candidate appointed by the employer to vote”, he wrote.
“On the eve of the second round of the presidential elections, many news items such as the one presented here have been published and investigated so that they are strongly fought. Electoral harassment is a very serious conduct and an attack on the exercise of democracy.”
Benvenutti was also forced to delete the video from all social networks. If any of the determinations is not complied with, Transben must pay a fine of R$100,000 plus R$1,000 per injured employee.
The MPT received 1,256 complaints of electoral harassment involving 1,027 companies until this Monday (24). Minas Gerais leads the national ranking with 286 cases. The state is followed by Paraná (123), Santa Catarina (104), São Paulo (94) and Rio Grande do Sul (75).
