Federal Public Ministry investigates roadblocks and charges PRF

The MPF (Federal Public Ministry) opened this Monday (31) investigations into the circumstances of the blockades on federal highways. The agency demands measures from the PRF (Federal Highway Police), which will have 24 hours to send explanations about the case.

Prosecutors of the Republic in the five regions of the country have already instituted procedures on the situation and point to the commission, in theory, of the crime against the democratic rule of law.

One of the documents to which the Sheet had access states that the motivations for the protests “are explicitly contrary to the democratic rule of law, requiring military intervention out of mere discontent with the outcome of the presidential elections”.

In a statement, the PRF stated that it is “with personnel mobilized at the blocking points and remains working for the free flow of federal highways”. At 4:30 pm this Monday, the police updated the number of occurrences on a social network: 138 interdictions or blockades in the country.

On Sunday (30), the PRF failed to comply with the order of Minister Alexandre de Moraes, president of the Superior Electoral Court, by intensifying operations against public transport for voters. The director general of the police, Silvinei Vasques, went to the TSE to explain the episode.

Reports that Bolsonarista truck drivers decided to block roads began to circulate on social media as soon as the electoral court announced the victory of former President Luiz Inácio Lula da Silva (PT) over President Jair Bolsonaro (PL).

The police have so far accounted for blockages or agglomerations on roads in 16 states and the Federal District. There have been or are ongoing protests in Rio Grande do Sul, Santa Catarina, Paraná, Minas Gerais, São Paulo, Rio de Janeiro, Mato Grosso, Mato Grosso do Sul, Goiás, Rondônia, Pará, Acre, in Amazonas and the Federal District.

In the statement, the department said that “since yesterday [domingo, 30 de outubro]when the first interdictions appeared, the PRF took all measures to return to the normality of the flow, directing teams to the locations and initiating the negotiation process for the release of the highways, prioritizing dialogue”.

“The PRF called the AGU (Advocacy-General of the Union) in all states where blocking points were identified, to obtain a prohibitory interdict in the Federal Court, with the objective, as a preliminary point, of issuing a court order as a way of peacefully guaranteeing the maintenance of fluidity. on the highways,” he said.

Members of the MPF understand that the PRF is able to act administratively against the blocks, for example the imposition of fines, without the need for judicial support.

THE Sheetthe AGU reported that the institution’s legal opinions endorse the PRF’s official action (without the need to take the matter to the judicial sphere), as occurred in 2018, on the occasion of the truck drivers’ strike in the government of former President Michel Temer ( MDB).

“The AGU’s judicial action occurs only when, in the specific case, the police institutions understand that they need a judicial measure to guarantee the release of highways”, said the lawyer.

In official letters to the state superintendencies of the PRF, prosecutors demanded measures from the corporation, such as monitoring protests and imposing fines.

They also ask for the identification of the owners of the vehicles used to block the roads, for future civil and criminal liability.

It is the mission of the PRF, according to its bylaws, “to plan, coordinate and execute the policing, prevention and repression of crimes on federal highways and areas of interest to the Union”.

The corporation was asked by the MPF in Mato Grosso to carry out “all possible steps to identify the leaders of the movement, including photographic records, intelligence reports and identification of the vehicles and machines used”.

In Pará, the Attorney General’s Office called the Federal Police to launch an investigation and gather information so that movement leaders can be identified and eventually held accountable.

Deputy Attorney Elizeta Maria de Paiva Ramos, coordinator of the 7th Chamber of Coordination and Review of the MPF, asked the Director-General of the PRF for information on the measures being taken to ensure the maintenance of the flow on federal highways, including the complete list of blockages and the respective actions undertaken by the agency in each case.

The 7th CCR is the MPF collegiate in charge of procedures relating to the external control of police activity and the prison system.
