BTG obtains injunction not to return BRL 1.2 billion to Americanas

BTG Pactual bank obtained a writ of mandamus against the injunction obtained by Americanas on the last 13th, found out Sheet.

With this, the bank is not obliged to return to the retailer R$ 1.2 billion already charged on the last 12th, the eve of the company obtaining the injunction protecting its assets from creditors and debt foreclosure.

In practice, the order suspends the effects of the injunction obtained from the 4th Business Court of Rio de Janeiro, until the judgment of the appeal by the judge Leila Santos Lopes, of the 15th Civil Chamber of the Court of Justice of Rio.

The decision was signed by the case rapporteur. Judge Flávio Marcelo de Azevedo Horta Fernandes, from the 2nd Criminal Chamber of the Court of Justice of Rio de Janeiro

The measure is valid only for BTG, due to the amounts compensated before the precautionary request of the Americanas.
