Businesses that were excluded in the first phase from the exemption from the pretense fee also have the right to appeal with the stamp, as the relevant decree was published on Wednesday in the Official Gazette, which gives them the opportunity to claim the exemption again until August 28.

The relevant ERGANI platform is open for submitting objections.

Based on the legislation, those businesses and freelancers who increased their full-time jobs by at least 25% from September 1, 2022, compared to the corresponding period of 2021, are exempt from the application fee – which ranges from €400 to €1,000.

According to KYA:

Businesses that meet the conditions and whose tax year ended on January 31, 2023, have already been informed by AADE by email by July 7.

Businesses that meet the requirements and have their tax year on February 28, 2023 will also be notified electronically but will be notified by August 14.
Those who are NOT informed will have the right to appeal until August 28.

It is estimated that just over 65,000 beneficiaries have already received the coveted exemption email.

However, too many saw their inbox empty either because of mistakes in the application or because they declared the recruitments by hand and not electronically as they should have.

The objection submitted concerns the correctness of the full-time employment data kept in Ergani and requires the employer to check the data regarding the full-time recruitments he has made and submit an objection only in cases where these data do not agree with those kept in Ergani .

According to the guidelines given by the Ministry of Labor, objections may NOT be submitted by:

Those who are already exempted. That is, employers who find individual errors in their application cannot correct them once they have been notified that they are exempt.
The overdue ones. After August 31st, no mistake, no matter how blatant it is, will not be recognized.

The objection is made through the special electronic platform of ERGANI and must be accompanied by the required supporting documents.

In the objection, the interested party fills in only the cases of full-time employees he hired and who are not found in the ERGANI registers as he has found.
