Globo transfers BRL 318,600 by mistake and fights to get money back

A Globo employee transferred R$ 318,600.40 to the wrong person, and now the company is fighting in court to get the money back. The man graced by the mistake told the judiciary that he could not return the money because he bought a property with the value.

The action was presented by the broadcaster on January 11. Two days later, Judge Luiz Felipe Negrão, of the 3rd Regional Civil Court of Barra da Tijuca, in Rio de Janeiro, denied granting urgent relief to determine the seizure of the money until the conclusion of the process.

According to the decision report, the money was deposited by mistake on December 27, 2021 and was supposed to settle a labor agreement. Globo said in the action that there was a “lapse” in the transfer of the money.

Rede Globo says it does not comment on cases in progress in court.

“After being notified of the mistake [o homem que recebeu o dinheiro] informed the impossibility of returning, due to having purchased a property with the value that he had identified in his account”, the judge wrote in the report, based on the request of the broadcaster.

For the magistrate, the request presented by Globo had technical errors that prevented its analysis. Among them, said the judge, was the amount attributed by the company to the case, R$ 1,000, which he considered unreasonable.

“Now, if there is an alleged overpayment of BRL 318,600.40, the value of the case cannot be BRL 1,000”, he wrote.

In another order, this one dated January 24, the judge asked the broadcaster to explain whether the man who received the deposit in error was a party to the agreement reached in the Labor Court. Globo must also inform why it has the man’s bank details and telephone contact.

The company was given 15 days to correct the initial petition – update the value of the claim, provide information about the relationship with the recipient of the money, and file its request for final relief (which, in the end, the company expects with the action). ).
