According to the decision of the head of AADE, Giorgos Pitsilis, the amending declarations of donation tax and parental benefits will be submitted digitally if:

* They are due
* The original declaration has been submitted through the myProperty app
* The relevant notarial document of the donation/parental benefit has not been drawn up

The benefit is twofold. On the one hand, the citizen does not need to bother to inform E9 about the change, on the other hand, the risk of “overflowing” ENFIA and fines in case the new owners forget to declare the change in their property is zeroed out.

This facility is essentially the third step in the statement transformation process
real estate transfer.

The first step was taken last summer with the automatic updating of E9 in cases of sales.

The second step had to do with only certain cases of parental benefits and donations.

The automatic submission process includes the following steps:
– Before the digital submission of the gift tax return or parental provision of real estate through the myProperty application,

it is necessary for the donor/parent to update the details of the transferred property to the current property status shown in the Property Register.

– When the notary public posts the contract in the myProperty application, a declaration is automatically created
real estate data (E9) for each party (donor/parent and donee/child) with changes in real estate related to either table 1 “DETAILS OF PLOTS (INSIDE PLAN OR SETTLEMENT) AND BUILDINGS (INSIDE AND OUTSIDE PLAN)” or table 2 “FIELD DETAILS” thereof.

– The following applies to the property data declaration that is automatically generated:

* For the donor/parent, the fields of the real estate data declaration related to the description of the property
filled in with the data corresponding to the Property Identification Number (ATIK) of the transferee
property and are derived from the current property status of his real estate in the OPS
Real Estate Portfolio.

The “Change Code” column is completed with code 3 (property deletion).

* For the donee/child, the fields of the declaration of real estate data relating to the description of the property
filled in with the data corresponding to the ATAK of the transferred property and drawn from the current
asset status of the donor/parent’s immovable property in the OPS Real Estate Portfolio.

The “Change Code” column is filled in with code 1 (declaration of a new property).

For all contracting parties, the fields of the real estate data declaration “contract number”, “notary tax number” and “contract date” are filled in with the data obtained from the myProperty application.

In the field “notes of the taxpayer” is written the phrase “Automatic generation of statement E9
from myProperty.

– After the property data declarations (E9) are automatically created, they are posted in the contracting party’s inbox
in the digital portal “myAADE” electronic notification, followed by sending an email to
their declared e-mail address, in order to be informed about the creation of the submitted real estate data declaration.

– The procedure is also applied in the event that it is not possible to automatically create a statement of real estate data due to a technical or other inability to link the data of the real estate or when the contracting party had already submitted a statement of real estate data
for the same property before its automatic creation by the system.

– Property data declarations (E9) that are automatically generated are considered to have been definitively submitted.

The date of submission of the declaration is considered the date of posting of the donation or parental provision contract in the myProperty digital application.
