The First Department of the Council of State is expected to discuss tomorrow whether or not two pensions can be granted to the same former employee (retiree).

In more detail, three (3) applications for cancellation will be discussed tomorrow at the CoE with the vice president as chairman Kostas Kousoulis and the State Councilor as rapporteur Marina-Alexandra Tsakali.

In these cases, a document of the Deputy Minister of Labor and Social Affairs is challenged Panagiotis Tsakloglouin which it is provided that the provision of the law (article 7 par. 5 of law 4387/2016) according to which the beneficiary of several pensions receives only one national pension, applies even in the case that someone is entitled to a pension due to death (widow) and pension for a different reason (due to old age or disability).

It should be noted that until now widow pensioners, who were entitled to a pension for a different reason at the same time, were granted a double national pension.

The contested document provides that:

a) does not have retroactive effect (therefore, the non-granting of the second national pension applies to widow’s pensions awarded after 1.1.2022),

b) double national pensions already paid to death pensioners will continue to be paid as a personal difference and

c) the additional amounts of national pensions paid are not sought.

The SC will decide whether the contested document is a circular to the e-EFKA for the interpretation and application of the law or whether it is a decision that sets new rules, which, since it was not published in the Official Gazette, is not valid and must be annulled.

Finally, within the next period the relevant decisions are expected to be issued by the Council of Ministers.
