Publication by the State to claim private real estate is suspended for six months for Kostis Hatzidakis initiative
It will be suspended for six months (until September 30, 2025), the publication by the State to claim private real estate, as well as the progress of pipelines already filed and pending, according to an amendment to be tabled in Parliament, at the initiative of the Minister of National. Economics and Economics Kostis Hatzidakis.
This amendment, and in particular with the overall legislation to follow, addresses a major problem that has arisen for thousands of owners across the country, who were confronted with the ownership of their property.
With these lawsuits, the State claims property or even entire areas on the basis of documents of even the Turkish occupation. The lawsuits have multiplied in recent months, in view of the completion of the Land Registry and the expiration of deadlines for the exercise of correction of the first cadastral registrations.
It is noted that in most cases these lawsuits are rejected as unfounded as the Supreme Court has ruled that the documents of the Turkish occupation are not sufficient but – in order to accept the lawsuit – a title or real law or occupation by the State are needed. However, lawsuits are still deposited because there are no overall criteria yet for when they will be brought and not to guide the administration and the State Legal Council.
These criteria – based on the case -law of the Supreme Court – will be introduced next time with the overall legislative intervention under training. This arrangement will provide the Administration and the State Legal Council the guidelines for the claims that the State will make and the cases in which it will not be opposed to citizens. As a result, many of the pending trials, whose progress is suspended, will end with the resignation of the State and avoiding unnecessary suffering of citizens, the involvement of the services and the State Legal Council with cases that do not benefit from State, as well as the burden of the courts.
Until the adoption of the total regulation, there is a six -month suspension arrangement, which provides that no new lawsuits will be filed and that the progress of the procedure will be temporarily suspended for six months. There will be immediate information from the General Secretariat of Public Property on all the relevant Real Estate Services of the State.
It is noted that citizens wishing not to delay their proceedings may request the normal progress of the trial at their request to the President of the competent three -member Council. Thus, citizens who do not wish to await overall legislation but expect their immediate judicial justification are not affected by the amendment.
