See the Article 29 revision payment schedule

Insured persons entitled to review article 29, also known as review of aid, will receive the amounts of the last payment batch from May 2, according to the INSS (National Social Security Institute).

After ten years of waiting, 10,491 beneficiaries will receive arrears that make up for the mistake made by the INSS between 2002 and 2009 when paying disability benefits, such as sick pay and accident pay. Heirs of these policyholders are also entitled.

The amounts will be released to policyholders who, in 2012:

• They were up to 45 years old in April
• They no longer received the benefit calculated with error
• They were entitled to arrears from BRL 6,000.01

Between April 17, 2002 and October 29, 2009, the INSS erred in paying disability benefits, including disability retirement. In 2012, after legal action, the agency agreed to close an agreement and pay the amounts due.

At the time, the institute failed to discard the lowest 20% of salaries when calculating the average salary, resulting in a lower social security income. The correct thing was to consider the 80% largest payments, but the INSS made the calculation including all salaries, which reduced the benefit.

According to the institute, the payment will be made according to the April competence calendar, on the dates in which the deposit occurs for those who earn above the minimum wage, today at R$ 1,212.

To find out if you will have the money in this lot, the insured can make an inquiry on the internet or by phone. The check is carried out on the Meu INSS app or website or by the number 135, from Monday to Saturday, from 7 am to 10 pm. As payment processing must be completed by the end of April, the INSS recommends that consultations be carried out after this period.

When accessing the Meu INSS homepage, either on the website or application, enter the CPF and the password of the Gov.br portal. On the next page, go to the top blue bar, where it says “What do you need?”, and type the word review. The option “Benefit Review – article 29” will appear.

It is necessary to click on the text and, on the next page, access “Consult Benefit Review – Art. 29”. If you have money receivable, this information will appear. If there are no values, the message will be that the “Consultation to Review Article 29 did not return data to the citizen”.

The review began to be paid in 2013 and was automatic, covering policyholders entitled to correction without having to make an administrative request to the INSS. However, there were errors and those who thought they were entitled, but did not enter the payment schedule, had to go to court.

According to social security lawyers, there were also cases of policyholders who were on the list, received the letter informing them that they would have the money, but were not paid. In these cases, it is also necessary to seek the Judiciary, as well as those who received and disagree with the amount paid.

Who was left out of the review

At the time of the agreement, the INSS left out a group of policyholders, among them the following benefits:

1. that had already been reviewed administratively or in court
2. granted in the period of provisional measure 242, with benefit start date on 03/28/2005 and benefit dispatch date on 07/03/2005)
3. granted until 04/17/2002, when the right expired, since the public civil action dates from 2012, except when there was an administrative requirement for this review before 04/17/2012
4. granted within the selection period, but which resulted from benefits achieved by decay
5. granted in the period included in the agreement, but were preceded by benefits starting before 11/29/1999

Action was proposed by MP and union

The public civil action that gave the right to review was proposed by the Federal Public Ministry and by Sindnapi (National Union of Retirees and Pensioners of Força Sindical). Lawyer Tonia Galleti, coordinator of Sindnapi’s legal department, was one of those responsible for the action at the time.

According to her, in the period, several lawyers filed individual actions and obtained victory, but the joint movement between union and prosecutor was what boosted the recognition of the right to all.
