Tata Werneck, currently on air as Anely from Globo’s telenovela “Terra e Paixão”, filed a lawsuit against Atlas Tecnologia. She alleges that, without her knowledge, the company used her image on social networks to give credibility to the business, five years after the end of the contract that the actress had as a poster girl for the brand.
Through an injunction, she also asks that Meta, owner of Facebook, withdraw the pieces from circulation. O F5 had access to the lawsuit, which is being heard at the 1st Special Civil Court in Barra da Tijuca. Atlas is investigated at the CPI of Cryptocurrencies for an alleged pyramid scheme valued at R$ 7 billion. The company used a fake robot to attract investors promising quick profit, but it would have left more than 200,000 victims in Brazil and other countries.
Tata was hired by Atlas in 2018, when the company was trying to increase its popularity in Brazil. At the time, there were no reports of problems for those who invested in relation to the financial returns made in the financial institution.
After being summoned to testify at the CPI at the beginning of the month, Tata’s lawyers did a sweep and discovered that Atlas was still using pieces produced years ago as if they were new, making use of its credibility in the advertising market. The actress got an injunction at the STF (Federal Supreme Court) so she didn’t have to testify.
According to a document obtained by the report, Tata signed the contract in May 2018. In theory, Atlas should comply and withdraw all of its image by December 28 of that year, seven months after signing. However, since then, Atlas has reportedly continued to use Tata’s image to sell its services.
“When the author became aware that she would be summoned to testify at the CPI of cryptocurrencies, just because she was an Atlas poster girl, it was discovered that the defendant [Atlas] had not removed the advertisements from her Facebook profile, maintaining 15 publications of photos and videos with the image, voice and name of Tata Werneck”, says the initial petition of the action.
The actress’s defense asks for the removal of the 15 advertising pieces by Facebook, which would pay a fine of R$ 1,000 per day if it fails to comply with the request. Atlas will also have to pay BRL 52,000 for the misuse of its image.
Ricardo Brajterman, Tata Werneck’s lawyer, confirmed the requests, but says that the judge in the case did not grant the initially requested urgent injunction. “The judge did not grant an injunction at this first moment and wanted to hear what Atlas has to say. We are waiting for their defense manifestation”, commented the lawyer.
The report tries to contact Atlas by email since last Tuesday (15), but did not receive a response until the last update of this text.
