This Monday’s birthday (16), actress Fernanda Montenegro, 94, filed a lawsuit against her neighbor for moral damages. Fernanda says her house was flooded due to irregular renovations carried out at the site.
O F5 had access to the process document, which is being held at the 15th Civil Court of the TJ-RJ (Court of Justice of Rio de Janeiro). The case happened at the end of the first half of this year.
Fernanda says that her apartment, in the Ipanema neighborhood, south of Rio de Janeiro, started to have leaks because her neighbor made structural changes to the place without authorization from the condominium.
Fernanda Montenegro requested an injunction requesting the resident of the building to renovate her apartment to remedy the problems caused, in addition to compensating her for moral damages in the amount of R$20,000.
Judge Flávia Justus denied the injunction. According to her, “more evidence is needed regarding the origin of the leak, so that the work can be carried out.” A conciliation hearing was also ruled out due to the emergency of the case and its peculiarities.
In the coming weeks, the judge should analyze the merits of the issue proposed by Fernanda. An exact date has not yet been decided.
