Court vetoes testimony from Samara Felippo’s daughter who allegedly suffered racism at school

The 2nd Children and Youth Court of the TJ-SP (Court of Justice of São Paulo) determined this Wednesday (12) that the daughter of actress Samara Felippo, who allegedly suffered racism from classmates at Vera Cruz school in April, do not testify about the case.

O F5 had access to the decision. The 14-year-old girl was speaking to respond to a request from her mother’s lawyers, who wanted the court to hear her version of the facts before continuing the process investigating the conduct of her schoolmates.

In the decision, published in the Official Gazette of the Union, the 2nd Court determined that the young woman participate in the hearing as a listener, without commenting on what happened. The 2nd Court also denied that the family had access to the case records.

For lawyers Hédio Silva Jr., Thaís Cremasco, Anivaldo dos Anjos and Isabela Dario, who defend Samara Felippo and her daughter, they say that the decision could constitute an abuse of authority.

“It is frightening to say the least to see that a childhood judge does not want to listen to a teenage victim of violence. You only need to read the Constitution, international treaties, the Child and Adolescent Statute (ECA) and several other federal laws to know that the judge is obliged to listen to the minor, whether she likes it or not”, says Hédio Silva Jr.

According to lawyers, the accused minors have already confessed to Vera Cruz school directors that they committed the act. The parents of the minors also admitted the act and apologized to Samara and her family. The defense also says that these statements have not been taken into account in the process.

Samara Felippo’s lawyers say that this Wednesday (12) they will take measures to request the judge’s removal from the case and will appeal to the Federal Supreme Court (STF) so that the family has access to the case, and the minor, heard.
