Influencer Bruna Bianincardi and player Neymar left the house where they lived in Cotia, in the metropolitan region of São Paulo, after finding out that they were being watched by security cameras installed inside the property.
The case was brought to court in April this year, but was closed through an extrajudicial agreement between the parties. The last procedural movement was registered on August 7, with the request for filing the process. According to the action brought by Bruna, the problems began shortly after the signing of the lease agreement, in March 2024, in the monthly amount of R $ 41 thousand.
According to the document, from the beginning, the couple would have been the target of invasive approaches by the owners. Bruna states that the landlord and his wife tried to get closer to the influencer and the athlete, asking for photos, triggering Bruna’s team to deal with issues with no relationship with the contract and sharing personal information.
In addition, the owners of the property would have kept access to the images of the internal security cameras, even after claiming that they had uninstalled the applications and exchanged the passwords of the devices. Conversation prints attached to the process show that the home owners used the recordings to claim that Bruna would have breached rules by leaving her dog circulating in certain areas, although the contract did not prohibit the presence of animals.
For the influencer’s lawyers, the conduct violated the General Data Protection Law, the intimacy of the family and clauses of the contract that required discretion by the owner. The use of audios captured by internal cameras is also cited without consent.
The defense claimed violation of the General Data Protection Law (LGPD), family intimacy and contract clauses that required the lessor’s discretion. One of the clauses expressly highlighted that the identity of the occupants should be preserved, at risk of contract termination.
Another discomfort point pointed out by the influencer in the process was the revelation that the homeowners were investigated for crimes such as money laundering and hiding of assets. Bailiffs began to visit the property frequently, bringing subpoenas and notifications of collection – which, according to Bruna’s lawyers, injured the so -called “peaceful possession.”
For these reasons, influencer chose to leave the property. His legal team notified those responsible for the lease and requested the termination of contract without penalties, attributing the breach of the agreement to the conduct of the lessor. The action also included an indemnity claim for moral damages.
