Rachel Sheherazade has second defeat in court against Alexandre Frota

Journalist Rachel Sheherazade, 48, had a new defeat in a lawsuit against Alexandre Frota, 58, in the second instance in Justice. She claims to have been offended by the deputy and asked for compensation of up to R$50,000. However, most judges rejected the appeal of the former SBT presenter for moral damages.

According to the process to which the F5 had access, judged by the 9th Chamber of Private Law of the Court of Justice of São Paulo, Rachel filed a lawsuit over videos on YouTube in which Frota said that she had received money to change her political opinion. At one point Frota said that “she prostituted herself” and sold herself into politics “for money”.

She also says she felt offended after a part of the video insinuated that she should present the newspaper on Rua Augusta, a point in the capital of São Paulo known as a place where call girls work. In the second instance, according to the TJ-SP, Rachel’s allegations were dismissed. Now, there is a new appeal in higher spheres such as the Superior Court of Justice.

If Frota was successful in this lawsuit brought by Sheherazade, the same did not happen in the lawsuit involving singer Chico Buarque. In February 2021, he was sentenced by the Rio de Janeiro Court to pay R$50,000 to the singer for moral damages. The singer-songwriter filed the lawsuit because of a publication made by the federal deputy toucan on Twitter, in October 2017, in which he claimed that Chico Buarque would have benefited from resources diverted from the Rouanet Law.

For the singer’s defense, the false information “hurt his honor, his image and his good name”. Initially, Chico Buarque asked for R$100,000 in compensation. Judge Rossidélio Lopes, of the 36th Civil Court, of the Court of Justice of Rio, determined the amount of R$ 50 thousand.

According to the magistrate’s decision, Frota’s publication on Twitter “far exceeds the criticism for the author’s performance. [Chico Buaque] as an artist and as a political agent to impute cursing and crimes without having any proof.”

In January of that year, Rachel won a labor lawsuit filed against SBT for the recognition of an employment relationship. In the sentence, to which the F5 had access, the judge recognized that the former presenter was hired as a legal entity, and the Justice recognized that this served as a way to circumvent the hiring via CLT.

The decision was in the first instance and could still be appealed. SBT was contacted to comment on the process, but did not respond until the publication of this report.

Sheherazade had been hired in March 2011 and was fired in October 2020 from SBT. The case was being processed in the TRT-2 (Regional Labor Court of the 2nd Region – São Paulo).
