Singer Marcelo Falcão, 48, who had been under house arrest for non-payment of pension to his 22-year-old daughter, now has his request revoked by the courts.
According to the Court of Justice of Rio de Janeiro, the case is being processed in the 18th Family Court. Last Wednesday (17), the 7th Civil Chamber upheld a request by Habeas Corpus about the arrest.
The process also follows in secret from the Court, but it is possible to verify that the injunction was granted at the request of the musician’s lawyer.
The old decision defined that Falcão would have to serve the sentence in his house, for 60 days, and wear an electronic ankle bracelet during that period.
“The negligence of the debtor in relation to the fulfillment of his obligation to pay all the alimony to his daughter, who is now older, is demonstrated. Numerous opportunities were granted without the debtor voluntarily fulfilling his obligation”, said judge André Cortes Lopes, of the 18th Court family’s.
Falcão, who is currently on tour outside Brazil, says in the process that he cannot pay the amount, which today would be above R$ 80 thousand. He cites the end of O Rappa and the pandemic as reasons for his supposed professional decline and claims to have gone bankrupt by being barred from playing shows for the past year.
His 22-year-old daughter was discovered by him only in 2016. After a DNA test, he recognized her as an heiress.
After the arrest decree, Falcão stated that he never failed to fulfill “nothing before the courts” and that his daughter would be wanting to destroy his career.
