The thriller about strong nerves develops into abduction of 6-year-old Pedersen Rainer Jason by an unknown man last year in Kifissia as as the hours go by new facts see the light of day.
Judicial disputes, both in Norway and in Greece, seem to compose the puzzle of this abduction, while the solution to this heavy bond – as it has developed – is to be given by the Supreme Court.
Norwegian reports in the last hours report that in a court that had taken place in Norway the father had won custody of the child and that the mother had abducted the child and brought him to Greece while some others report that little Jason is wanted internationally from the moment he stopped being in the care of his father in Norway.
THE skai.gr talked with the lawyer of the father of the 6-year-old who had handled his request for the child to be returned to Norway in accordance with the Hague Convention.
As mentioned by Mrs. Maria Adamopoulou, she has no contact with her father on this issue as she has been talking to him since February, when she filed an appeal against the decision of Greek courts, in the Supreme Court on his orders.
“There is a Norwegian court ruling which gives him exclusive custody. Beyond that, the dispute was over the implementation of the Hague Convention on the Abduction of Minor Children. “Mr. Petersen had sought to return the child to Norway because he had been illegally transferred to Greece.”
According to Ms. Adamopoulou, the father had initiated proceedings in Greece claiming that his right to custody had been violated because the mother during the summer communication she had with the child took it and did not return it back to Norway.
“There was a court in Greece where the Court of First Instance and the Court of Appeal ruled that the mother did not return the child to the father illegally, but because the child has adapted to life in Greece, the court does not order the child to be returned to Norway immediately.”
This was the last collaboration she had with her father who, following this decision of the Greek courts, instructed her to apply to the Supreme Court as she claimed that this decision did not apply the Hague Convention.
As for the decision that the father has challenged before the Supreme Court, he says that the mother took the child to Greece and wrongly did not return it to the father, with the question whether he has committed abduction as described in the Hague Convention. However, according to judicial circles, the Hague Convention has a clause in which it says that if there has been a child abduction, the court must immediately order the return of the child unless it deems that the living conditions of the child there will be unbearable.
“The court ruled that the child is used to Greece, so his life in Norway will be unbearable. I have filed an appeal in the Supreme Court “.
