Pierrakakis: The Unified Certificate of Inheritance is coming

In the context of simplifying public sector procedures, the Minister for Digital Governance, Kyriakos Pierrakakis, presented today to the Council of Ministers the bill “Emerging information and communication technologies and other provisions”, which, among other things, includes the adoption of the Single Certificate of Inheritance.

In particular, in Single Certificate of Inheritance combine the:

(a) a certificate of renunciation or non-will by the Magistrates’ Court;

(b) a certificate of publication of a will or not by a Magistrates’ Court;

(c) a certificate of publication of a will or not by a Court of First Instance;

(d) a certificate of non-infringement of inheritance by a Court of First Instance;

(e) a certificate of declaration of inheritance right by a Magistrates Court.

The Single Certificate of Inheritance will be valid for a period of time six months from its version (digital or physical).

Also, in the same context is provided:

  • Abolition of the Register of Malesutilizing the capabilities of the Interoperability Center for the extraction and verification of critical data
  • Provisions that establish MITOS (ie the system by which the State records its procedures)

New technology

The bill fills the existing regulatory gap regarding the existence of a coherent framework, which will allow the safe use of new technologies by public and private sector actors.

The introduced regulations, faithful to the logic of minimal regulatory intervention and fully aware of the dynamic nature of new technologies, are a first attempt to delimit the most basic aspects of new technologies, following in some places successful examples abroad.

At the same time, this legislative initiative includes arrangements that are part of the fulfillment of the country’s EU obligations as well as arrangements aimed at further simplifying the public sector and enhancing the country’s digital transformation.

Specifically, it is provided:

Artificial Intelligence

  • Establishment of advisory committees of experts to monitor the effective implementation of the National Strategy for the Development of Artificial Intelligence
  • Establish an obligation for medium and large companies to report on the use of Artificial Intelligence applications:

(a) employees when such applications are used to make employer decisions; and

(b) consumers, when such applications are used to create consumer profiles

  • Establishing an obligation for medium and large companies to keep a register of Artificial Intelligence applications and a data ethics policy

Cyber ​​security

  • Protecting the public sector against cyber attacks through the creation of new organizational schemes (Hybrid Threat Analysis Observatory, National Cybersecurity Certification Authority, National Coordination Center for Cyber ​​Security) and institutional roles

Internet of Things

  • Establish an obligation for critical public and private sector infrastructure to inform the National Cyber ​​Security Authority about the use of Internet of Things technology devices and to comply with the Authority’s guidelines.

Distributed Universal Technologies

  • Institutionalization of the digital tool of “smart contracts”, regulation of the issues of their validity, validity and binding, in order to be a means of strengthening the confidence of the counterparties in the security of transactions

3D Printing

  • Crystallization of the network of rights and obligations of actors involved in the supply chain of 3D printing products (manufacturer, intermediaries, distributors) in particular by supplementing the existing framework for the protection of intellectual property rights

Use of SMEA for the provision of postal services

  • Establish arrangements for utilizing the capabilities of Unmanned Aerial Vehicle systems for the provision of postal services while reducing operating shipping costs
