Areios Pagos: “Yes” to the transfer of the oil found in the tanker Lana

The ship had been seized by the Greek authorities off the coast of Karystos

With decision No. 1057/2022, the First Criminal Division of the Supreme Court rejected the shipping company’s appeal Times Navigation in the case of the tanker Lana and the cargo of 104,134 metric tons of oil on board.

As is known, the Iranian-flagged ship Lana, which as Pega was originally Russian-flagged, was carrying Iranian oil and last April had sunk in Karysto due to mechanical failure. Subsequently, the ship was seized by the Greek authorities off the coast of Karystos, following a request for judicial assistance submitted by the US District of Columbia within the framework of the Greece-US intergovernmental agreement, on the grounds that the revenue from the sale of the oil would they ended up financing terrorism and it would be strengthened financially for further terrorist acts, but also with the argument that the ship belonged to the Russian Promsvyazban.

There followed a series of decisions of the Appeal Court of Chalkida-Evia on the disputed issue and finally the company Times Navigation appealed to the Supreme Court against the last decision of the Appeals Council of Chalkida which called for the return to the tanker of part of its cargo which had been transferred to the tanker of Greek interests “ICE ENERGY”.

The First Criminal Division of the Supreme Court rejected Times Navigation’s appeal on the grounds that since the shipping company “did not participate in any way in the trial at first instance”, but also because “no legal relationship is invoked, it is not actively legitimized in the exercise of the appeal”.

It is noted that this case had resulted in retaliation by Iran, post “Islamic Revolutionary Guard Corps” which seized two Greek tankers in the Persian Gulf, the “Delta Poseidon” of Delta Tankers of Diamantis Diamantis and the “Prudent Warrior” of Polembros of Spyros Polemis, which remain at the anchorage of the Iranian port of Bandar Abbas with a total crew of 49 sailors, including 10 Greeks.
