Ntogiakos: The recipient of lawsuits is the First Instance Prosecutor’s Office, not the Supreme Court Prosecutor’s Office

As is well known, petitions submitted to the Prosecutor’s Office of the Supreme Court are forwarded for further proceedings to the Athens Prosecutor’s Office of First Instance or to the local competent Prosecutor’s Office of First Instance.

On the occasion of press reports and complaints from lawyers who want to file indictments with the Prosecutor’s Office of the Supreme Court and not with the Prosecutor’s Office of First Instance, the prosecutor of the Supreme Court Isidoros Dogiakos, in his announcement, states that “recipients of the lawsuits-petitions as well as the crimes it is not the prosecutor of the Supreme Court or its deputy prosecutors, but exclusively the prosecutor of the Misdemeanors”.

As is well known, petitions submitted to the Prosecutor’s Office of the Supreme Court are forwarded for further proceedings to the Athens Prosecutor’s Office of First Instance or to the local competent Prosecutor’s Office of First Instance.

The full text of Mr. Dogiakou’s announcement is as follows:

“On the occasion of recent statements and complaints by lawyers as well as citizens in the printed and electronic press, on social media and on television channels, it is announced that, in accordance with an express provision of the Code of Criminal Procedure (article 42 par. 2 sub. a’ thereof) and according to the fixed interpretation of this, the competent addressees of lawsuits-reports as well as of crimes are not the prosecutor of the Supreme Court or his deputy prosecutors, but exclusively the prosecutor of Misdemeanors and all investigative officers, general or special, regardless of whether they are local authorities, before whom they must operate”.
