The police officer who shot the 16-year-old Roma is free: The reasoning of the judicial council

The judicial council of Thessaloniki unanimously decided to release the 34-year-old police officer, but raises 4 crucial questions for the main investigation concerning the crucial last seconds of the life of 16-year-old Kostas Fragoulis

Four questions which are connected to the last seconds of the bloody chase that resulted in the death of the 16-year-old Roma by police fire, the Thessaloniki Misdemeanor Council puts in the resolution it issued and by which it is unanimously decided that the 34-year-old accused police officer of the DI.AS group. he should be released on the restrictive condition of being banned from leaving the country.

These questions seek answers through the main investigation being carried out on the case and concern the two shots that came from the service weapon of the accused police officer, one that successively hit the vehicle and the head of the 16-year-old, and the other that was “stuck” in the entrance of adjacent hotel.

According to information, the first ordinary investigator of Thessaloniki is called to seek answers to the following:

*** the sudden reversal of the agricultural vehicle driven by the Roma minor was the result of his unconscious movement when he was hit by the critical shot of the policeman or was it due to a conscious choice of the victim who wanted to escape towards the Roma settlement “Agia Sofia”

*** the critical shot fired by the defendant, which successively hit the vehicle and the head of its driver, followed or preceded the other shot that hit the hotel entrance

*** the two shots were a double shot by the accused with single aim or they took place with consecutive aim, after a relative movement of his hand with which he was holding his service weapon

*** as long as sufficient, convincing and compatible with the forensic findings answers are given, the most crucial of all questions can finally be answered if the police officer, when executing the shots in question, was aiming at a height of 20-30 centimeters from the ground, as he claims , or at a height of 100-120 centimeters from the ground, the height at which the two fireballs were found embedded.

The reasoning of the Judicial Council

Regarding the decision not to impose the measure of temporary detention against the accused police officer, but to release him with a restrictive condition, with which the investigator and the prosecutor disagreed (in favor of the former), the judges of the Council, in their reasoning it seems how they took into account – among other things – that the 34-year-old is not suspected of fleeing or of committing new criminal acts, and especially regarding the latter since he was suspended, by decision of the Hellenic Police Headquarters. and no longer bears arms.

In addition, the Council – as reported by information – assessing the circumstances of the pursuit, accepts that the act in question was carried out under the pressure of making immediate decisions, self-protection, protection of his colleagues and society as a whole, and in general, crisis, in the context of a particularly stressful and situational intensity […] taking into account the “aggressive behavior of escalating intensity” that the 16-year-old displayed towards the police officers.

The next legal steps

The main investigation into the case is ongoing and in the next period the case file will return to the investigator who will ask the prosecutor to initiate a new criminal prosecution, a more correct legal characterization of the act attributed to him, given that the death of minor. For the new act – that of manslaughter with possible intent – he will be asked to give a new, supplementary statement before the investigator.
