The Prosecutor’s proposal

Last Friday, the District Attorney requested the conviction of the defendant for intentional homicide in a calm state of mind, noting that when the defendant arrived at the scene, his father was alive and he was the one who shot first when he saw Giorgos Xylouris struggling with his father.

Maliata, requested that the defendant’s claim that he was in a state of mental rage be dismissed as, as he said, he had the option after the first episode, either to move away or to lock himself in his house. However, he, acting sober, went to his house and got the gun.

For Lefteris Kalomiris, he spoke of a modest man with talent for whom everyone had a good word to say.

On the day of the incident, as he said, “the defendant was with his friends in a cafe in the village, when he accidentally met Giorgos Xylouris. As soon as they met, they immediately quarreled for no apparent reason and certainly for no serious reason, “over nothing”. The accused treated him harshly, hit him in the face using his knowledge of boxing (…)

Then the accused was removed and the deceased Giorgos Xylouris, with the assistance of other persons, was locked inside the house. However, while they were trying to calm him down, he escaped in a rage by jumping from the balcony door.

Instead of moving away from the village, the accused took a gun from his father’s house and went under the house of Xylouris, uttering threats.

Lefteris Kalomiris and other relatives managed to remove him for the second time from the Xylourides’ house.

Xylouris in the meantime, having escaped, took a weapon from his vehicle and in a furious state and with homicidal intent headed to Kalomiris’s house.

Lefteris Kalomiris tried to stop him by saying “Hey George, are we going to be killed for lies?”. Then and while the two were fighting, the accused arrived. He approached Xylouris and shot him on contact.

The first two shots

Xylouris while falling to the ground shot Lefteris Kalomiris.

In total Xylouris was shot 7 times while Lefteris Kalomiris received a fatal bullet.

“The accused confesses to his act but claims that when he did it he was in the heat of the moment. However, the claim must be rejected,” said the Prosecutor.

As the accused said, he acted coldly and soberly with an absence of emotions, with complete clarity of thought and in a calm state of mind.

Finally, he stated that Georgios Xylouris also showed criminal behavior, however he “forgave” and asked the Court to judge him guilty of intentional homicide in a calm state of mind by shooting from contact a total of seven times.
