The possibility of appealing against the decision of the Council of Misdemeanors for the tragedy in Mati, is being studied by the Appellate Prosecutor’s Office. The prosecution is said to be examining, on the one hand, the acquittal of 10 of the 28 accused, which is unanimously ordered by the judges in their panel, and, on the other hand, the criminal charge that asks the panel to investigate five accused.

More specifically, according to information, the Appellate Prosecutor’s Office is studying the panel of the Council of Criminal Procedure, issued three days ago for the case of the deadly fire in Mati, which left behind 103 dead in July 2018. The prosecutor’s office is considering an appeal. for the part of the disputed parliament that orders the acquittal of 10 accused, mainly police officers but also deputy mayors, in order to re-judge the possibility of their referral.

At the same time, the Court of Appeals is studying the part of the parliament, which requests the upgrade to a felony, of the charge for five officers of the Fire Service, who were in charge of it during the deadly fire. The Appellate Prosecutor’s Office, after studying the evidence, will judge whether the Council of Criminal Procedure attributed the correct criminal characterization to the actions of the five officers.

It is recalled that the panel of the Council of Criminal Procedure orders:

A. Further interrogation for five officers of the Fire Brigade with an upgraded charge, from the misdemeanor of “serial negligent homicide”, to a crime involving “lethal exposure to danger”.

B. Referral to trial of 13 defendants (former governor, executives of the Civil Protection and Fire Brigade, as well as mayors), before the three-member Criminal Court, for offenses related to negligent homicide, depending on their involvement due to competence, at any stage tragic result: That is, in prevention, extinguishing, evacuation and rescue.

C. Release of 10 accused, police officers and deputy mayors.

The judges of the Council for Criminal Procedure, in their panel, differed considerably from the proposal of the prosecutor, George Polykratis. Mr. Polykratis, in his proposal, had suggested the referral of 27 of the 28 accused, leaving essentially out of criminal liability, only the co-pilot of the coordination helicopter. In his proposal, he explained why the accused should be tried for misdemeanors and not for crimes – contrary to what the investigator Athanasios Marneris had repeatedly requested, and the final decision of the Misdemeanor Council for the five officers of the Fire Brigade. According to the prosecutor (who in his proposal listed one by one the causes that contributed to the catastrophic fire to turn into an unspeakable tragedy) the tragic result led to “combined convergent negligent behavior.”
