Death of three children in Patras: Prosecution investigation into the leaks in the case

The Prosecution is targeting the leaks of information from the judicial investigation into the case of the deaths of the three children of the temporarily detained Roulas Pispirigou.

By order of the head of the Prosecutor’s Office of First Instance Sotiria Papageorgakopoulou, a preliminary examination begins with the subject of breach of judicial secrecy in the case of the three deaths investigated by the Judiciary, an investigation which based on the order of the prosecutor has a specific purpose, as it seeks both the competent official or the party who discloses or disseminates or discloses judicial confidential information as well as the recipients of this information published.

At the same time, it is requested to ascertain the commission of crimes that concern violation of the law on personal data and in particular the provision concerning illegal processing of personal data.

According to the order of Ms. Papageorgakopoulou, the criminal investigation aims to “establish the violation of judicial confidentiality by a person to whom judicial confidentiality was accessible due to his service or participation in the process and incitement to it as well as illegal processing of personal data ». The reason for the prosecutor’s intervention were recent publications with the testimonies of witnesses in the investigation process “regarding the case of the death of the minor children of the accused Roula Pispirigou”.

According to the Penal Code (Article 251) judicial secrecy consists of:

“Facts, documents or information when they relate to: a) a meeting of a judicial council, b) a conference or secret ballot, c) acts carried out during the interrogation, d) a court meeting held in camera, when the publication of its elements cause a risk of infringement of another or (e) elements related to arbitration or mediation, when their disclosure creates a risk of infringement of one party “.

The punishment provided for the violators of the article is determined in prison and a fine. If by violating judicial secrecy the perpetrator “intended to deprive himself or anyone else of any benefit or harm to another, imprisonment of at least three years and a fine” is imposed. The same penalty shall not apply to “anyone to whom judicial secrecy was available due to his service or participation in the proceedings as a lawyer or a party”.
