Antonis Manitakis: “The government’s amendment for Kasidiaris’ party is absolutely constitutional”

“THE government amendment which concerns the participation of parties, whose members are involved in criminal actions, is in accordance with the constitution, he said to the radio station of Thessaloniki, Status fm 107.7 and Dimitris Venieris and Virginia Dimaresi, the professor of constitutional law, Antonis Manitakis.

“Kassidiaris, as long as the case is pending in the second degree, has the right to take part in the elections, but not with the party he belongs to and leads today” which is proven by the data concerning the head of the specific party. However, “if he participates in a new party that will attempt to contest the elections, the Supreme Court must, within two or three days, find sufficient evidence to reject the request.” However, as he claims “time is limited and it will be difficult to investigate the case in depth”

“Any political force that is considered a criminal organization does not have the right to participate in the elections and the Supreme Court will remove any submission of its participation request,” he stressed, however, answering a related question, that “this does not concern the party’s positions, however extreme they may be they”.

Referring to the opposition’s proposal that any party official who was convicted in the first instance and who filed an appeal cannot be a candidate, he emphasized that “the party is not prohibited from taking part in the elections based on our constitution.”

Finally, with reference to the members of November 17 or other terrorist organizations who would like to take part in the elections, the professor clarified that “the same applies to members of criminal organizations”
