What the Supreme Court decided contrary to the decisions of the Supreme Court
Ioanna Mandrou
After the hearing of the case for the MPs who were elected with the Spartans and are being prosecuted for cheating the electorate following prosecution by the Prosecutor of the Supreme Court herself, the decision of the so-called Electoral Court is expected to be issued regarding their parliamentary fate.
As the Electoral Court became aware, Supreme Special Courtchaired by the President of the Council of State Evangelia Nikas and with the participation of supreme judges from the three supreme courts, decided to postpone the issuance of a decision on the parliamentary presence in the Greek parliament of the Spartan party until the criminal decision is issued for the persecuted members of the .
The criminal court is set to take place on June 19 with defendants of the party MPs, except for the leader Vassilis Stigas as they are being prosecuted for deceiving the electorate and entering the Greek parliament as Spartans, when in fact they were a showcase party of the imprisoned Golden Dawn Ilias Kasidiari.
With the same rationale o Supreme Court (A1 Department) recently banned the participation of the Spartans in the upcoming European elections, however the Electoral Court decided otherwise. In other words, he should wait for the criminal case to decide what he will do with the Spartans, i.e. if he will decide to expel them from the Parliament and the possibility of distributing their seats to other parties.
However, after the adjournment decision, this scenario is greatly postponed as the criminal decision is required to be irrevocable, which requires a long period of time.
At the same time the Electoral court accepted the objection of the ND candidate for Greveon MP Athanasios Stavropoulos against the MP of the same party and the same electoral district Ioannis Yatsos. Thus, Mr. Yattsos loses his seat and Mr. Stavropoulos is declared an MP.
The objection was based on the relevant constitutional provision which provides that “the duties of the deputy are incompatible with being a partner or shareholder or member of the Board of Directors of a company, which undertakes projects or studies or related contracts of a development or investment nature”.
