Daniel Alves’ infidelity will be the basis of the appeal that the lawyer Cristóbal Martell Pérez-Alcalde will present to the Justice so that the player can remain free during the investigations of the Spanish police.
Alves, 39, is under arrest after being accused by a 23-year-old woman of having raped her in the bathroom of a Barcelona nightclub, in the early hours of December 31.
According to the Antena 3 TV network, Pérez-Alcalde has already written the appeal and believes that his client can avoid prison. The lawyer was in the prison for two hours this Friday morning (27) and would have said that Alves gave him a very solid version of what happened at the club.
Speaking briefly to TVE on his way out of prison, the lawyer said that the player seemed in a state of shock and that previous versions “must have been to hide his wife’s infidelity”.
Alves would have, according to Antena 3, recognized “infidelity, but not aggression” and that, therefore, there would be no reason to remain in prison. He did not want the woman, the model Joana Sanz, to know about the betrayal, which is why he would have said that he did not know the alleged victim when he was arrested.
In addition, the lawyer will propose precautionary measures to ensure that Alves does not flee, such as the use of an electronic bracelet, a high bail and delivery of the passport.
Antena 3 also reported that Alves prefers that his mother and brother, who are in Barcelona, not go to prison to visit him because he does not want to be seen behind bars. The player has been imprisoned since Friday (20) in the Brians penitentiary center, in the metropolitan area of Barcelona.
He shares a cell with a bunk bed, bathroom and shower with a boy who was once Ronaldinho’s bodyguard and who is convicted of sexual assault. In prison, he has been treated well by other inmates, even signing autographs.
