A 10-year-old boy was arrested in jail after sending a text message to a friend indicating a gun that authorities deemed a threat to shoot at school.

From Florida, Daniel Marquez was sentenced to 21 days by a judge when he was accused of writing threats last weekend.

Authorities allege Daniel sent three messages suggesting he intended to shoot the Cape Coral Patriot Elementary School student.

However, Daniel’s attorney, Douglas Molloy, claims the message sent just four days after the shooting at a school in Uvarda, Texas, was out of context, the Daily Mail reports.

Daniel’s nightmare began when the boy’s father, whom he was texting, reported the text to the Lee County Sheriff’s Office. After that, I decided to use the full power of the law to honor elementary students.

Authorities say they sent the “I bought this” message along with images of the four assault rifles before sending another “Get Ready for Water Day” text.

After Daniel was arrested, the Lee County Sheriff’s Office released his name, pictures, and images released by lawmakers warning that a “false threat” would lead to “real consequences.”

As is known, DailyMail.com reports that he is currently being held at a juvenile training school in the Collier district of Naples, 55 miles from his home.

In a radio interview with Carmin Marseno, Sheriff Lee said his team “didn’t wait a second” and added that “we are investigating all threats as if they were real.”

“I ran a campaign,” he said.

“False threats, real consequences.

“I understand that the boy is 10 years old, but his brain is not fully developed. He is underage.

“When a 10-year-old boy does a trick, the result is the same regardless of age,” the sheriff explained.

But Moroi, who is fighting to free Daniel, claims the text was an attempt at childish humor.

“According to the reviews I received, Daniel was texting his friends, and they were going back and forth between streams of text on various topics,” Moroi told DailyMail.com.

“And I should just call it an attempt at humor, but it’s fifth grade humor.

“He did make a sad mention of the assault rifle, but only as a joke that had nothing to do with the attack on the school.”

Mr Molloy spoke about how excited the boy was to celebrate the end of school, Water Day, as the couple’s next conversation was “a little out of time”.

“There was no clue to connect these two things. There must be something interesting,” he added.

“He didn’t say outright that he was going to shoot up the school.

“Concludes. There is more to talk about Water Day and events.

“But it has nothing to do with shooting him or pointing his gun at him.”

As is well known, Daniel’s father, Derek Marquez, was not allowed to accompany his son in a sheriff’s car when he was arrested, and instead met his son at the sheriff’s station.

He refused to speak to the media.

Molloy said Daniel was “crying all day” after he was arrested.

“I have made an appeal to the Public Ministry of the State. We are going to discuss the possibility of a release,” he added.

“My job is to get it out and bring it back to life, and not everyone at the age of 10 will see it forever different.

“People still consider him an honor student, which is a tragic side effect of cancer, which was very prevalent in American society at the time.
