AADE: Up to 96-hour locks on businesses that do not “send” retail sales data to MyDATA

AADE will start handing out fines and lockouts for up to 96 hours to those businesses that do not transmit electronically, as they are obliged to do, from October 1st, the data of retail sales on the my data platform.

Relevant provisions are included in the bill of the Ministry of Finance which was submitted today to the Parliament, which also incorporates the supplementary budget of 2.9 billion euros.

With the provisions of the bill, the penalties are defined for the non-transmission of retail sales data, which are issued through the Tax Electronic Mechanism (F.H.M.) and it is provided that, from 1.10.2022, in the event of non-transmission of the data, i.e. summaries of issued retail revenue documents, which are transmitted to the myDATA digital platform through the Information

of the Tax Electronic Mechanisms System (FEM) of the A.A.D.E., the required fine is imposed on the liable entity on a case-by-case basis (article 173).

The operation of a professional establishment is immediately suspended:

– for forty-eight (48) hours, if it is established that the non-transmission to the Information System of Tax Electronic Mechanisms (TME) of AADE, more than the ten (10) details of retail sales that have been issued through the Electronic Tax Mechanism (TME), or, regardless of number of them, that the untransmitted value of the goods or services exceeds five hundred (500) euros, for ninety-six (96) hours, if, within the same or the following fiscal year from the detection of the above violations, it is detected again , from the same partial on-site control, the non-transmission to the Information System (FIM) of AADE of at least three (3) items of retail sales that have been issued through FIM, regardless of their value. (Article 174).
