Argentina: Prosecution of four people for ‘inciting hatred’ against Vice President Kirchner

Four executives of a far-right organization in Argentina are facing criminal charges for “inciting hatred” against Cristina Kirchner, a federal judge announced Thursday, as part of a parallel investigation into the attempted assassination of the vice president.

Jonathan Morel, Leonardo Sosa, Gaston Guerra and Sabrina Vasile, leaders of the Revolución Federal, are accused of “publicly inciting hatred, intolerance and collective violence against a leader (…) to the extent that it led a person to commit what, according the words of members of Revolution Federal, would be ‘written in history’, that is, the attempt on the life of the vice president”, according to the indictment.

These four individuals “exceeded the limits of the exercise of freedom of expression and the constitutional right to protest,” Judge Marcelo Martinez de Giorgi explained in the 60-page document.

The proceedings have run parallel to the investigation into the attempted murder of Ms Kirchner on September 1, when a young man pointed his gun at her but was unable to fire.

The four defendants were remanded in custody since October 20, then temporarily released by order of the appeals court, which assessed that they did not pose a risk to the investigation.

Judge Martines de Giorgi underlined that the far-right organization “stopped its publications” after the attempt on the life of the former Peronist president (2007-2015).

The attempt was made in front of Ms Kirchner’s home in Buenos Aires by Fernando Andre Chabag Montiel, 35: he approached her and pointed his gun in the face, but it did not go off when he pulled the trigger.

The man and his partner, Brenda Uliarte, 23, have been remanded in custody and charged with attempted murder by Judge Maria Eugenia Capuchetti, who is handling the case.

Brenda Uliarte was recorded on video taking part in a demonstration against the centre-left government organized by the Revolution Federal, with a mock guillotine and torches, in front of the government headquarters.

Mrs. Capuchetti believes that there is insufficient evidence to merge the two investigations.
