The government “strongly disagrees with the decision,” US Attorney General Merrick Garland said in announcing an appeal.
The US Department of Justice announced today that it will appeal a federal judge’s decision in Texas to suspend the marketing authorization – across the US territory – of mifepristone pills used for the medical termination of pregnancy.
The government “strongly disagrees with the decision,” US Attorney General Merrick Garland said, announcing an appeal and denouncing the judge’s ruling as “contrary to the judgment of experts at the US Food and Drug Administration (FDA), who have ruled for over 20 years that mifepristone is safe and effective.”
The ban on abortion pills “threatens women’s rights” in the United States, US Vice President Kamala Harris has said.
Ten months after the US Supreme Court’s historic decision that gave each US state the right to ban abortions on its own soil, conservative Justice Matthew Kasmerik ruled to ban mifepristone pills at the federal level, following an appeal by anti-abortionists.
At the same time, however, a judge in Washington ruled that the marketing authorization of these preparations cannot be suspended in at least 12 states.
Therefore, it is up to the Supreme Court – whose composition was overhauled by Republican former US President Donald Trump – to clarify the situation.
Kasmeric’s ruling is not set to take effect for at least a week after the judge gave the federal government time to appeal.
“It’s a shame,” said Planned Parenthood president Alexis McGill Johnson. “We should all feel outraged that a judge is unilaterally dismissing medical evidence.”
Senate Democratic leader Chuck Schumer criticized the decision by “an activist judge” which “sets a dangerous precedent.”
Matthew Kasmeric was an adviser to a conservative Christian organization before being appointed a federal judge by former US President Donald Trump.
Clinics offering abortion services have announced that if mifepristone is banned, they will resort to misoprostol preparations for the medical termination of pregnancy. However, the exclusive use of misoprostol preparations is not considered equally effective.
