“A kiss without express or implied consent is actually sexual assault”
The Supreme Court of Spain decided that the kiss without “consent” can be considered sexual assault.
According to Barron’s, the Supreme Court upheld a decision by the Andalusian Judiciary that sentenced a police officer to one year and nine months in prison for kissing a female prisoner on the cheek.
“A kiss without express or implied consent constitutes in fact a sexual assault,” the court said, adding that “it is clear that the fleeting contact of a non-consensual kiss constitutes a physical invasion».
The question of including kissing in sexual assault practices is of concern in Spain, among others, as the former head of the football federation, Luis Rubiales, is expected to stand trial after he kissed star player Jenny Hermozo on the lips at the Women’s World Cup during the medal ceremony, after the Spain beat England, causing embarrassment and anger to those who witnessed the incident.
The 46-year-old Rubiales claimed that it was a consensual “kiss”, contrary to the claims of Hermoso, who filed a lawsuit against him last September, claiming that she was initially pressured to defend him.
