A judge was taken with the part of two defendants for criminal law crimes who argued that the former personal lawyer by President Donald Trump Alina Hamba He cannot prosecute them because he was appointed illegally federal prosecutor in New Jersey.
This decision is a defeat for the Ministry of Justice and Trump who attempted with various maneuvers to keep the hub on this position, bypassing the court ruling on which its temporary appointment for 120 days was not allowed to be extended.
“As for the question of whether Mrs Habba is legally performing the duties of the United States prosecutor for the New Jersey region, I conclude that not,” regional judge Matthew Bran writes in his rationale.
The case of the Huba legitimacy has reached court by two defendants in a drug case, Julien Junjor Junior and Junior Gytir III, who challenged Trump’s procedural maneuvers with the aim of staying in the position of another 210 days.
Bran noted that the Huba’s actions after July 1st “may be declared invalid, including approval for the referral of accused Cesar Umberto”, an investor accused of fraud, money laundering and a politician. This does not mean, however, that the case of the table will be rejected.
Bran’s ruling can lead to other legal appeals by defendants in New Jersey and even block hundreds of cases from reaching the courts.
The hub was appointed a temporary prosecutor last March, in place of John Giordano, who took over as ambassador to Namibia.
